Website Care Plan Terms

These Service Terms govern the Website Care Plans provided by Surefaze Business Websites and Marketing. By subscribing to and paying for a Plan, you agree to them.

These Service Terms (the “Terms”) govern the Website Care Plans (each, a “Plan”) provided by Surefaze Business Websites and Marketing (“Surefaze,” “we,” “us,” or “our”). By subscribing to and paying for a Plan, you (“you,” “your,” or the “Client”) agree to these Terms. The website you designate at checkout is the “Site.” If you do not agree to these Terms, do not purchase a Plan.

1. Plans & Fees

You select one of the Plans below at checkout. Fees are billed monthly in advance and recur each month until cancelled in accordance with Section 8.

“Included support time” refers to the cumulative time spent each month on content updates, support requests, and related tasks under your selected Plan. Unused time does not roll over to subsequent months. Current plan features are described on our Website Care Plans page, which is incorporated into these Terms by reference.

2. Scope of Services

Subject to your selected Plan tier, we will perform the following services for the Site (collectively, the “Services”):

  • Software updates — routine WordPress core, theme, and plugin updates, including updates to premium (pro) plugins.
  • Premium hosting — managed hosting with ultra-fast caching (where included in your Plan).
  • Daily backups — performed daily using two separate backup services, with 14-day retention.
  • Security & monitoring — security checks, malware cleanup, and constant uptime monitoring.
  • Content updates — limited content updates to the Site, within the included monthly support time.
  • Support — email and phone support at the level corresponding to your Plan.
  • Reporting & optimization — monthly report, and, where included in your Plan, pro SEO tools, privacy policy & cookie consent tooling, video training, regular form testing, two-factor authentication, monthly strategy session, weekly strategy check-ins, and monthly SEO review.

Specific feature availability varies by plan tier as published on our website. Any work you request that falls outside the Services or exceeds the included monthly support time is “Out-of-Scope Work” and is governed by Section 3.

3. Out-of-Scope Work & Overages

Time exceeding your Plan’s included monthly support time, new design or development work, migrations, content creation, and other services not listed in Section 2 are billed separately at our then-current hourly rate. We will tell you the applicable rate and obtain your approval before performing any billable Out-of-Scope Work.

4. Billing & Renewal

Your Plan fee is billed monthly in advance and automatically renews each month until cancelled under Section 8. Payments are processed through Stripe and comply with PCI standards. By purchasing, you authorize recurring charges to your payment method on file. We may adjust fees upon at least thirty (30) days’ notice, effective at the start of the next billing period; your continued subscription after that date constitutes acceptance of the new fee.

5. Your Responsibilities

To receive the Services, you agree to:

  • Provide timely access to the Site, hosting, domain, and any accounts or credentials needed to perform the Services.
  • Hold all necessary rights to content and materials you provide, and ensure they do not infringe third-party rights or violate law.
  • Respond to our reasonable requests for information or approvals needed to complete requested work.
  • Keep your billing information and payment method on file current.

6. Service Levels & Scheduling

Most updates are performed monthly; backups run daily; uptime monitoring runs continuously. Support requests are acknowledged and handled within forty-eight (48) hours on business days (Monday–Friday), excluding holidays. All Plans share this response target; with Priority support (Standard and Growth Plans), your requests are placed ahead of Basic-tier requests in our queue and worked first. We use commercially reasonable efforts to maintain Site availability but do not guarantee uninterrupted or error-free operation.

7. Third-Party Services; Backups; Disclaimers

The Services rely on third-party providers, including hosting, plugin developers, and payment processors (e.g., Stripe). We are not responsible for outages, defects, price changes, or discontinuation of third-party services. While we maintain security measures and daily backups, no website can be made fully immune to downtime, vulnerabilities, malware, or data loss, and we do not warrant that the Site will be free from security incidents.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Cancellation & Refunds

You may cancel at any time through your Stripe billing portal or by emailing us. Billing stops at the end of the then-current billing period, and there is no early termination fee. If you cancel within the first seven (7) days and have not used more than one month of service, we will issue a prorated refund. After that period, fees already paid for unused future time are non-refundable, but you may cancel at any time. We may suspend or terminate the Services for non-payment or material breach not cured within ten (10) days of notice.

9. Intellectual Property

You retain ownership of your pre-existing content, trademarks, and materials. Upon full payment for any applicable work, you own the deliverables created specifically for you, excluding our pre-existing tools, code libraries, processes, and licensed third-party components, which remain our property or that of their respective licensors. We may reference the engagement and display non-confidential work in our portfolio unless you ask us not to in writing.

10. Limitation of Liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to these Terms will not exceed the total fees you paid to us during the three (3) months immediately preceding the event giving rise to the claim.

11. Indemnification

You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from content you provide, your use of the Site, or your breach of these Terms.

12. Confidentiality

Each party will protect the other’s non-public information (including credentials and business information) and use it only as needed to perform or receive the Services. This obligation survives termination.

13. Governing Law & Disputes

These Terms are governed by and construed under the laws of the State of Alaska, without regard to its conflict-of-laws rules. We will first try to resolve any dispute in good faith through informal discussion. Any unresolved dispute will be subject to the exclusive jurisdiction and venue of the state and federal courts located in Alaska, and you consent to such jurisdiction.

14. Changes to These Terms; General

We may update these Terms from time to time; the “Last updated” date above reflects the current version, and your continued subscription after an update constitutes acceptance of the revised Terms. These Terms, together with the plan details published on our Website Care Plans page, are the entire agreement between you and us regarding the Plan and supersede prior discussions. If any provision is held unenforceable, the remainder stays in effect. You may not transfer your subscription without our consent. Sections concerning fees owed, intellectual property, disclaimers, liability, indemnification, and confidentiality survive termination.
